HOYNG ROKH MONEGIER obtains favorable decision for HUAWEI in preliminary injunction proceedings in Spain

We are pleased to announce that our Spanish patent litigation team has recently obtained a favorable decision from Commercial Court no. 7 of Madrid, which just rejected a petition for preliminary injunction against the Chinese Telecommunications manufacturer HUAWEI TECHNOLOGIES, S.L.  and the codefendant, the British multinational telecom company VODAFONE GROUP, PLC. 

HOYNG ROKH MONEGIER represents HUAWEI in these proceedings.

The petition has been raised by the Spanish company TOT POWER CONTROL, S.L as part of legal action for alleged patent and know how infringement for the use of Power Control technology in WCDMA network.

In this case the Court, taking into consideration the allegations and the evidence filed by HUAWEI, has rejected the preliminary injunction requested, finding that there is no such irreparable damage. 

This is a decision has been appealed before the Higher Court.
