The Brussels Commercial Court has ruled in favour of Philips in a cross-border design infringement suit against Fritel, the Belgian manufacturer of a copy of Philips’ Airfryer®.
The court followed Philips’ arguments and ordered the defendant, subject to a penalty, to recall and destroy all of the infringing products and to provide Philips with a list of all third-party manufacturers and suppliers of the product as well as the countries in which and sales channels through which the products were sold. The court held that production, marketing, promotion, import, export and storage of the infringing goods infringe Philips’ design rights.
