As a part of HOYNG ROKH MONEGIER’s series on statistics on the Unified Patent Court (UPC), this edition shows the UPC’s claimants’ activity across the Unified Patent Court. Based on published case law, it identifies the most active claimants, where claimants and defendants come from, which industries are most frequently involved in litigation, and how forum selection differs by claimants’ nationalities.

Some highlights ✨:

▪️The UPC is most frequently used by electronics and tech companies, with only 1 life sciences patentee in the top 10 of most active claimants.

▪️38% of claimant entities are non-European, mainly from North America and Asia. Looking beyond the filing entities, this number increases to almost 50%.

▪️Litigation is concentrated in telecom, network infrastructure and other technology-heavy fields, while life sciences also remain a significant area of activity.

▪️Unsurprisingly, the German local divisions still stand out, with Munich being particularly popular among US-based claimants.

▪️Filing patterns outside Germany appear more closely linked to domestic or regionally connected claimants.
