It’s time again for our quarterly overview of UPC case law! The article “The Unified Patent Court – A case law overview IV” by Klaus Haft, Sabine Agé, Giulia-Isabella Otten, Alix Fourmaux and Natali Goginashvili has been published in the current issue of GRUR Patent.
Almost 2 years after the launch of the Unified Patent Court more than 850 orders and decisions have already been issued by the Court of First Instance and the Court of Appeal, which demonstrates its popularity and its role as a unified court in European patent law. While the Unified Patent Court keeps clarifying important procedural issues, the number of decisions on the merits in infringement proceedings and the associated counterclaims for revocation increased as well as the final decisions and orders of the Court of Appeal.
The article provides an overview of the Court’s guidance on the UPC Agreement and the Rules of Procedure and aims to facilitate access to the published material.
