Unified Patent Court (UPC)
Most patent cases in Europe are nowadays brought before the Unified Patent Court (UPC). The UPC is a single venue for proceedings to enforce or invalidate Unitary patents (UPs) and European patents (EPs) (and any supplemental protection certificate based on it). The UPC’s decisions have effect for the whole of the UPC (and sometimes for other EP countries – in so-called cross-border decisions). Eighteen countries currently take part in the system (including Germany, France, Belgium and the Netherlands), and further EU member states may join in the future.

The 18 participating countries are Austria, Belgium, Bulgaria, Denmark, Estonia, Finland, France, Germany, Italy, Latvia, Lithuania, Luxemburg, Malta, the Netherlands, Portugal, Romania, Slovenia and Sweden.

2. Inside knowledge
We helped build the new system. Several of our partners were actively involved in conceiving the UPC system and the training of patent judges, and continue in advisory roles. Willem Hoyng, for example, joined the committee that developed the rules of procedure for the new courts and the committee advising the preparatory committee. This close involvement and inside knowledge of the new procedural system gives us a tactical advantage over most other European patent firms.
This was proven in practice: since the opening of the new court, our patent litigators have been entrusted with a very substantial number of UPC cases, quickly and firmly positioning us among the leaders in UPC litigation.
3. In depth knowledge of local custom
Traditionally, Germany, the Netherlands, France and Belgium have been the most important patent litigation venues in continental Europe. All of these countries host their own UPC divisions and, as expected, some “local custom” remains notwithstanding the UPC’s uniformity. Proper understanding of such custom constitutes a competitive edge, if only because the most experienced UPC judges come from these jurisdictions. Our seasoned patent litigators know the case law and background of these judges and devise the best litigation strategy for each case.
4. The necessary resources and expertise
Our team consists of more than 70 UPC representatives. Together they cover the entire spectrum of patent disputes. Regardless of the field – pharmaceuticals, biotechnology, chemicals, mechanics, high-tech or telecommunication systems – our people understand the technology and have over forty years of experience in pan-European patent litigation. They can recommend the best strategies to pursue in a given case. Our firm includes technically trained patent attorneys who support our trial lawyers where necessary, resulting in cost-efficient litigation teams.
